1. Acceptance of Terms
By accessing or using the Smart Solar Group website (smartsolar.au) and our services, you agree to be bound by these Terms and Conditions. If you do not agree, please do not use our website or services. These terms constitute a legally binding agreement between you and Smart Solar Group.
2. About Smart Solar Group
Smart Solar Group is a solar energy installation company operating in North Queensland, Australia. We are CEC (Clean Energy Council) Accredited Installers and hold all required licences for electrical and solar installation work in Queensland.
3. Our Services
Smart Solar Group provides the following services:
- Residential and commercial solar panel system design and installation
- Battery storage system installation
- Solar system maintenance and monitoring
- Solar rebate and incentive application assistance
- Solar finance facilitation (through third-party finance providers)
- Energy assessments and consultations
4. Quotes and Proposals
All quotes and proposals provided by Smart Solar Group are estimates based on information available at the time. Quotes are valid for 30 days unless otherwise stated. Final pricing may vary based on site inspection findings, changes in equipment costs, or additional work required. A formal contract will be provided before any installation work commences.
5. Payment Terms
5.1 Direct Purchase
For direct purchases, a deposit may be required upon signing the contract. The balance is due upon completion of installation and commissioning. We accept bank transfer, credit card, and other payment methods as specified in your contract.
5.2 Finance Options
We offer finance options through third-party finance providers. Finance approval is subject to the provider's terms and conditions, credit checks, and approval processes. Smart Solar Group is not a finance provider and does not guarantee finance approval. “$0 upfront” and “0% interest” offers are subject to finance provider terms and credit approval.
5.3 Solar Rebates
Quoted prices typically include the STC (Small-scale Technology Certificate) rebate already applied. Rebate values are based on current rates and may change. Smart Solar Group will process STC claims on your behalf. The rebate is a federal government incentive and is subject to government policy changes.
6. Installation
All installations are performed by licensed electricians and CEC Accredited Installers. Installation timelines provided are estimates and may be affected by weather, equipment availability, grid connection approvals, or site-specific factors. We will communicate any delays promptly. The customer is responsible for ensuring safe and clear access to the installation site.
7. Warranties
7.1 Product Warranties
All solar panels, inverters, and batteries come with manufacturer warranties as specified in the product documentation. Typical warranty periods include:
- Solar Panels: 25-year performance warranty, 12-year product warranty
- Inverters: 5-10 year manufacturer warranty (varies by brand)
- Batteries: 10-year manufacturer warranty (varies by brand)
7.2 Workmanship Warranty
Smart Solar Group provides a 5-year workmanship warranty on all installation work. This covers defects in installation, wiring, and mounting. It does not cover damage caused by external factors (storms, impact, modifications by third parties).
7.3 Australian Consumer Law
Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these terms limits your rights under the Australian Consumer Law.
8. Limitation of Liability
To the maximum extent permitted by law, Smart Solar Group's total liability for any claim arising from or related to our services is limited to the amount you paid for the specific service giving rise to the claim. We are not liable for indirect, consequential, or incidental damages, including loss of profits, loss of data, or business interruption.
Smart Solar Group does not guarantee specific energy production levels or savings amounts. Estimates provided are based on historical data, system specifications, and industry-standard calculations, but actual performance may vary based on weather, usage patterns, and other factors.
9. Cancellation and Cooling-Off Period
Where applicable under Australian Consumer Law, you have a 10-business-day cooling-off period for unsolicited agreements. For solicited agreements, cancellation terms are specified in your individual contract. Cancellations after equipment has been ordered may incur restocking or cancellation fees as outlined in your contract.
10. Intellectual Property
All content on the Smart Solar Group website — including text, images, logos, graphics, and software — is the property of Smart Solar Group or its licensors and is protected by Australian and international copyright laws. You may not reproduce, distribute, or use our content without prior written permission.
11. Website Use
You agree not to:
- Use our website for any unlawful purpose
- Attempt to gain unauthorised access to our systems
- Interfere with the operation of our website
- Submit false or misleading information through our forms
- Scrape, copy, or reproduce website content without permission
12. Dispute Resolution
In the event of a dispute, we encourage you to contact us first to attempt an informal resolution. If a dispute cannot be resolved informally within 30 days, either party may refer the matter to mediation administered by a mutually agreed mediator. If mediation is unsuccessful, either party may pursue resolution through the Queensland Civil and Administrative Tribunal (QCAT) or the relevant court of competent jurisdiction.
13. Governing Law
These Terms and Conditions are governed by and construed in accordance with the laws of Queensland, Australia. You submit to the exclusive jurisdiction of the courts of Queensland for the resolution of any disputes.
14. Changes to These Terms
We reserve the right to modify these Terms and Conditions at any time. Changes will be posted on this page with an updated “last updated” date. Continued use of our website or services after changes constitutes acceptance of the revised terms.
15. Severability
If any provision of these Terms and Conditions is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.
